Musannaf Ibn Abi Shaybah

Hazrat Abdullah bin Umar narrates that Hazrat Abu Bakr and Hazrat Umar would not kill a free man who had killed a slave.

Hazrat Hakam states that Hazrat Ali (may Allah be pleased with him) and Hazrat Abdullah bin Masood said: When a free man kills a slave, he will be killed in retribution.

Hazrat Mughira narrates that Ibrahim said: A slave will be killed in place of a free man, and a free man will be killed in place of a slave.

Hazrat Suhail bin Abi Salih narrates that I asked Hazrat Saeed bin Musayyib about a person who has killed a slave. He replied: He will be killed in retaliation for that slave. The narrator says: I went to him again, and he said: He will be killed in retaliation for that slave. Then he said: By Allah! If all the people of Yemen were to gather for the killing of that slave, I would kill all of them in retaliation for that slave.

Hazrat Suhail bin Abi Salih narrates that I asked Hazrat Saeed bin Musayyib about a free man who has intentionally killed a slave. He replied: Kill him as well, even if the people of Yemen unite over his blood.

Hazrat Abu Al-Wadain narrates that I asked Imam Sha’bi about a free man who deliberately killed a slave. He replied: Kill this despicable and lowly person in place of the slave.

Hazrat Muhammad bin Amr narrates that Hazrat Umar bin Abdul Aziz said: A free man will not be killed in retribution for a slave.

Hazrat Waki’ says that I heard Hazrat Sufyan saying: A man will be killed in retaliation for killing someone else’s slave, but he will not be killed for killing his own slave, just as if he kills his own son, he will not be killed in retaliation.
