Musannaf Ibn Abi Shaybah

Hazrat Harith narrates that Hazrat Ali (may Allah be pleased with him) said: Whoever places a water spout on a stone outside, or does so without having the right, will be held liable.

Hazrat Mughira narrates that Ibrahim said: Whoever constructs any building other than his canopy will be held liable.

Hazrat Shurayh used to require compensation for damages caused by pits and wells made on pathways, and similarly, he would require compensation for damages caused by wood placed on walls. However, he would not require compensation for wells constructed outside the city of Kufa in graveyards or for the benefit of Muslims.

Hazrat Laith states that Hazrat Tawus said: Whoever drives a peg into a place other than his own land and shelter will be responsible for any harm caused by it, and whoever digs a well in a place other than his own land will be liable for anyone who falls into it.

Hazrat Sha'bi narrates that Hazrat Shurayh said: Whoever places anything from his house onto the pathway, such as a stone or wood, or digs a well in the path of the Muslims, and then someone is harmed by it, that person will be held liable; blood money will be taken from him, but retribution (qisas) will not be taken.

Hazrat Hisham states that Hasan Basri said: Whoever creates an obstruction in the path of Muslims will be liable for any harm caused.

Hazrat Amr narrates that Hasan Basri stated in a marfu’ narration: Whoever extends anything beyond the boundaries of his land and thereby causes harm to someone, then that person will be held liable.

Hazrat Mansur narrates that Ibrahim said: When a person removes the pestle or stick used for pounding medicine from the wall, then in case of any damage, he will be held liable.

Hazrat Sha'bi narrates that Hazrat Ali (may Allah be pleased with him) used to cut the shields fixed on the doors of houses, or he said: he used to order them to be cut.

Hazrat Ata bin Saib narrates that Hazrat Shurayh used to hold the shopkeeper liable because of the obstruction and the pillar, and he used to say that he has erected this obstruction in someone else's property.

Ibrahim narrates that Amr bin Harith bin Musliqt dug a well in the path of the Muslims, and a mule fell into it and its bones were broken, so Hazrat Shurayh held him liable.

Hazrat Dinar narrates that Amr bin Harith bin Musallaq dug a well on the path of the Muslims. A mule was passing by and fell into that well, breaking its bones. Hazrat Shurayh held him liable for the price of the mule, which was two hundred dirhams, and he gave that mule to Amr.

Hazrat Sharik states that the shield of a neighbor of Hasan Abu Musafir fell on a child and that child died or was injured. Upon this, Hazrat Shurayh said: If he had been brought to me, I would certainly have held that person liable.

Hazrat Harith narrates that Hazrat Shurayh would not leave any canopy under which a horseman could not pass with his spear, and he used to say: "Make it according to the height of a horseman's spear."
