Musannaf Ibn Abi Shaybah

Hazrat Khallas narrates that Hazrat Ali (may Allah be pleased with him) used to hold responsible the one walking ahead, the one driving (the animal), and the one riding on the mount.

Hazrat Shurayh, Ibrahim, and Hazrat Sha’bi—all these personalities stated: The one who drives forward, the one who leads, and the rider will be held liable.

Hazrat Ismail bin Salim narrates that I heard Imam Sha’bi saying that if a man is driving his mount gently, then there will be no liability upon him, but if he is harsh while driving the animals and any harm occurs, then that person will be liable.

Hazrat Ash'ath narrates that Hasan Basri said: The one who drives (the animal) and the one who leads (it) will both be made guarantors.

Hazrat Khallas narrates that Hazrat Ali (may Allah be pleased with him) said: When the path is wide, there will be no liability on the one driving (the animal).

Hazrat Ibn Jurayj states that Hazrat Ata said: The leader, that is, the one walking ahead, will be fined. I asked: Will the driver also be fined if someone is injured on the hand or foot? He replied: He will call out, "Way, way."

Hazrat Hasan bin Hur narrates that Hazrat Hakam said: Certainly, the one who drives, the one who walks ahead, and the rider will pay compensation if their mount causes harm with its hand or foot, tramples, or kills someone.

Hazrat Laith states that Hazrat Tawus said: The one walking ahead, the one driving, and the rider will be held liable if their mount causes harm to someone with its front legs.
