Musannaf Ibn Abi Shaybah

Hazrat Dahhak narrates that Hazrat Ali (may Allah be pleased with him) said: There is no qisas (retaliation) for a wound that reaches inside the stomach, for a head wound that reaches the membrane of the brain, and for a head wound in which the bones become exposed.

Hazrat Mughira narrates that Ibrahim said: In the case of a head wound that reaches the membrane of the brain, a wound in which the bones become exposed, and a wound that penetrates into the abdomen, there is no qisas (retaliation). Indeed, in the case of intentionally inflicting a wound, blood money (diyat) will be obligatory upon the person's wealth.

Hazrat Ibn Jurayj states that Hazrat Ata said: Qisas (retaliation) will not be taken in the case of a wound that penetrates inside the abdomen, nor in the case of a wound that reaches the membrane of the brain, nor in the case of a wound where the bones of the head become exposed, nor will qisas be taken in exchange for a wound that poses a danger to a person's life, nor in exchange for a wound that cannot be inflicted in the same manner as the assailant inflicted.

Hazrat Ubaidullah bin Ubaid Kala'i narrates that Hazrat Mak'hool said: Retaliation (qisas) will not be taken in the case of a wound that penetrates into the abdomen, nor in the case of a wound that reaches the membrane of the brain, nor in the case of a wound that exposes the bones of the head, nor due to the breaking of the tip of the nose.

Hazrat Muammar narrates that Imam Zuhri said: There is no qisas (retaliation) for a wound that reaches the membrane of the brain or for broken bones.

Isa said that Hazrat Sha'bi stated: There is no qisas (retaliation) for a wound that reaches inside the belly, nor for a wound that reaches the membrane of the brain, nor for a wound that exposes the bones of the head, and there is also no qisas in the case of a broken thigh.

Hazrat Abu Bakr bin Hafs said: I saw Hazrat Ibn Zubair taking retribution (qisas) for a wound that had reached the membrane of the brain. The narrator says: I saw both of them walking together with wounds on their heads.

Hazrat Yahya bin Saeed said that Hazrat Ibn Zubair took qisas (retaliation) for such a wound in which the bones of the head had become exposed.

Hazrat Amr bin Dinar said that Hazrat Ibn Zubair took retribution (qisas) for such a wound in which the bones of the head became exposed. The narrator says that people were astonished at this, or he said that people began to be astonished at this.
