Musannaf Ibn Abi Shaybah

Hazrat Abu Huraira narrates that the Messenger of Allah, peace and blessings be upon him, gave the verdict of a slave or a slave-girl in the case of a child in a woman's womb being miscarried: The person against whom the verdict was given said, "Will compensation be given for one who neither drank nor ate, nor did he cry out loudly? Is such blood not wasted?" Upon this, the Messenger of Allah, peace and blessings be upon him, said: "Indeed, this person is speaking like a poet. In any case, in the event of causing the death of a child in the womb, giving a ghurra, that is, a slave or a slave-girl, is obligatory."

Hazrat Miswar bin Makhramah narrates that Hazrat Umar bin Khattab was consulting people regarding the compensation (diyah) for a child in a woman's womb who is killed before birth. Hazrat Mughirah bin Shu'bah said: I was present with the Prophet Muhammad (peace and blessings be upon him), and he (peace be upon him) gave the verdict of "ghurrah" (i.e., a male or female slave) in this matter. Hazrat Umar said to him: Bring someone who will testify to this decision with you. So Hazrat Muhammad bin Maslamah testified in his favor.

Hazrat Ata narrates that the Messenger of Allah, peace and blessings be upon him, said: In the case of causing the death of a child in a woman's womb, the compensation (ghurra) will be a slave, a bondwoman, or a mule.

Hazrat Hisham states that his father, Hazrat Urwah, said: In the case of causing the death of a child in a woman's womb, one must pay a slave, a bondwoman, or a horse.

Hazrat Ash'ath narrates that Imam Sha'bi said that "ghurra" refers to a male or female slave who will be given to the mother of the deceased child or to his close relative.

Hazrat Ash'ath narrates that Hazrat Ibn Sirin and Hazrat Hakam, both of these esteemed individuals, stated: In the case of causing the death of a child present in the womb of a free woman, one slave man or slave woman must be given.

Hazrat Muhammad bin Qais narrates that Imam Shabi, regarding a person who struck a woman on her abdomen causing her pregnancy to be aborted, stated as follows: That person will be liable to pay "ghurra," that is, a male or female slave.

Hazrat Jabir bin Abdullah narrates that the Noble Prophet (peace and blessings be upon him) said: In ghurrah, a male or female slave is given.

Hazrat Jabir narrates that Hazrat Amir said: At the very foundation of every pregnancy, there is a "ghurra," that is, a male or female slave. And Hazrat Hakam said: In the beginning of the pregnancy, there will be reconciliation until the creation of the child becomes apparent. Hazrat Waki' said: The statement of Hazrat Hakam is more preferable than the statement of Imam Sha'bi.
