Blood Money for the Tongue of a Mute and the Private Part of an Impotent Person
Hadith 28911
٢٨٩١١ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن جابر عن الشعبي عن مسروق قال: في لسان الأخرس حكم.
It is narrated from Hazrat Masrooq that the decision is in the speech of the mute.
Hadith 28912
٢٨٩١٢ - حدثنا أبو بكر قال: حدثنا الفضل بن دكين عن هشام الدستوائي عن حماد عن إبراهيم: في لسان الأخرس الدية كاملة.
It is narrated from Ibrahim that for the tongue of a mute person, the full blood money will be given.
Hadith 28913
٢٨٩١٣ - حدثنا أبو بكر قال: حدثنا وكيع عن أبي حنيفة عن حماد عن إبراهيم: في لسان الأخرس حكم، وفي ذكر (الخصي) (١) حكم.
It is narrated from Ibrahim that there is compensation for the loss of a mute person's tongue, and there is also compensation for the loss of a eunuch's genital organ.
Hadith 28914
٢٨٩١٤ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج عن قتادة قال: في لسان الأخرس [مما في لسان الصحيح.
Hazrat Qatadah said that the tongue of a mute person is one third of the blood money for a normal tongue.
Hadith 28915
٢٨٩١٥ - حدثنا أبو بكر قال: حدثنا عبد الوهاب بن عطاء عن عمرو عن الحسن قال: في لسان الأخرس] (١) الدية كاملة.
It is narrated from Hasan that full blood money will be given in compensation for the tongue of a mute person.
Hadith 28916
٢٨٩١٦ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: قلت لعطاء: في ذكر الذي لا يأتي النساء مثلٌ ما في ذكر الذي يأتي النساء؟ قال (لي) (١): نعم، و (قال) (٢) (لي) (٣): أرأيت الذي (قد) (٤) ذهب ذلك منه أليس يوفي نذره.
Hazrat Ibn Jurayj said that I asked Ata: For a person whose sexual organ is such that he cannot approach women, will the compensation (diyah) be the same as for a person who can approach women? He replied: Yes, and said: What do you think, if a person's sexual organ has been lost, is his vow not fulfilled?
