If a Woman Dies with a Child in Her Womb, What Should Be Done?
Hadith 25265
٢٥٢٦٥ - حدثنا أبو بكر قال: حدثنا (مخلد) (١) بن يزيد عن ابن جريج قال: سئل عطاء عن المرأة تموت وفي بطنها ولد؟ (٢) يسطو عليه الرجل فيستخرجه، فكره ذلك.
It is narrated from Hazrat Ibn Jurayj, he says that Hazrat Ata was asked about a woman who died while she was pregnant. (Is it permissible that) a man, having overpowered the woman, may extract the child? So Hazrat Ata disliked this.
Hadith 25266
٢٥٢٦٦ - حدثنا أبو بكر قال: حدثنا عبد الأعلى عن هشام عن الحسن أنه كان لا يرى بأسا أن يسطو الرجل على المرأة إذا لم يقدروا على امرأة تعالج.
It is narrated about Hasan that he saw no harm in a man overpowering a woman to deliver a child when no woman was available for treatment.
Hadith 25267
٢٥٢٦٧ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة قال: قالت أم سنان: إذا أنا مت فشقوا بطني، فإن فيه سيد غطفان، قال: فلما ماتت شقوا بطنها فاستخرجوا سنانًا.
Hazrat Mughira says that Hazrat Umm Sinan had said that when I die, you should cut open my stomach because the chief of Ghatafan is in my stomach. The narrator says: Then when she died, the people cut open her stomach and took Sinan out.
