If a Person Buys Something from Someone
Hadith 24878
٢٤٨٧٨ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا زياد (بن أبي زياد) (١) قال: اشتريت من رجل شاة فنقدته ثمنها، ثم جئت لأقبضها فقال البائع: إنها أرادت أن تموت فذبحها أهلي، (فخاصمته) (٢) إلى شريح فقال شريح: رد عليه الثمن.
Hazrat Ziyad bin Abu Ziyad narrates that I bought a goat from a person and paid the price. Then, when I came to take possession of it, the seller said that the goat was about to die, so I slaughtered it. I took the dispute to Hazrat Shurayh. Hazrat Shurayh said: Return the price for it.
Hadith 24879
٢٤٨٧٩ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا زكريا عن عامر أنه سئل عن رجل اشترى عبدًا فقال المشتري للبائع: (بعه) (١) لي، فهو منك أنفق (٢)، فمات العبد في يد البائع، فقال: يغرم البائع ثمنه.
Hazrat Amir was asked about a person who bought a slave, then the buyer said to the seller, "Sell him for me, he is more destitute than you." The slave died while in the seller's possession. He replied: The seller will be liable for its price.
Hadith 24880
٢٤٨٨٠ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن منصور عن إبراهيم قال: (إذا) (١) (اعتقب) (٢) البائع البيع ببعض الثمن، فمات فهو من مال البائع.
Ibrahim says that if the seller withholds the sold item with himself in order to receive the price, and it is destroyed, then it will be counted as the seller's property.
