Musannaf Ibn Abi Shaybah

A dispute regarding a slave girl who had the disease of debilah was brought before Hazrat Dahhak. This is a well-known disease that does not occur suddenly, so Hazrat Dahhak ruled against the seller. Hazrat Sufyan says that Hazrat Dahhak’s statement is more preferable to me than the statement of Hazrat Shurayh, that when it is known that it is not new, then it will be returned, and an oath will be taken from the buyer that he had not seen it before purchasing, and after seeing it, he is not satisfied with it.

24764 - (And he said) (1) Sufyan: And the statement of al-Dhahhak is (more beloved) (2) to me than the statement of Shurayh: If it is known that it is not among those things that are newly occurring (3), then it is to be returned, and it necessitates the oath of the buyer that he did not (see it) (4) before he bought it, and that he was not pleased with it after he saw it.
