Musannaf Ibn Abi Shaybah

Hazrat Shurayh made the man swear an oath when a claim of debt was made against his father; so if he swears an oath, otherwise it will be taken from him. And for your father, there is a debt upon a person which is claimed from him, so you will establish a witness; so if he swears an oath along with your testimony, otherwise it will not be given.

Ibrahim says that in both of these matters, an oath will be taken based on knowledge.

It is narrated from Hazrat Sha’bi (may Allah have mercy on him) that Hazrat Shurayh used to demand an oath from both the absent and the present. The narrator says that I asked Hazrat ‘Amir, “What is your opinion if someone claims a debt upon my father, about which I have no knowledge—can I take an oath on it?” He replied, “Yes, you can take the oath.” Then both of them strongly rejected this. He said, “The oath should be referred to the one who knows more than you.” And Hazrat ‘Amir used to accept this oath.

Ibrahim says that a person has not been made the guardian of his own self such that an oath should definitely be demanded from him, nor does anyone else have the authority to make him swear an oath upon his knowledge.

Ibrahim says that if a claim is made regarding someone's father, an oath will be demanded based on his knowledge.

It is narrated from Hazrat Ammarah bin Abi Hafsah that two people, while arguing, came to Hasan, and then said to him, "Make him swear an oath that his father did not testify in favor of his father." Hasan said, "Would any sensible person swear an oath on this?"
