Musannaf Ibn Abi Shaybah

Hazrat Sha'bi (may Allah have mercy on him) says that there is no condition for the deceased.

Hazrat Hakam says regarding the person who rented out his house for ten years, then died before the term ended, that the lease will be terminated and the loan for use (ariyah) will become void. Hazrat Mak’hool says that the loan for use (ariyah) should be fulfilled and the lease will become void. Hazrat Iyas bin Mu’awiyah says that both should be fulfilled until their respective ends. Hazrat Muhammad bin Sirin says that his heirs will inherit whatever he owned during his lifetime.

24624 - And Mak'hul said: The loaned item (ariyah) continues, and the rental (ijarah) is nullified.

24625 - Iyas ibn Mu'awiyah said: They proceed to their end.

24626 - He said: Ayyub: from Muhammad ibn Sirin: They only inherit from that which he used to own during his lifetime.

Hazrat Amir was asked that a woman had made a salam (forward sale) in her slave for a few months, then the woman passed away before the appointed time? Hazrat Amir said to her brother, "He is your slave; if you wish, take him, and if you wish, leave him."
