Musannaf Ibn Abi Shaybah

Hazrat Saeed bin Al-Musayyib said regarding the person who set a condition of service when freeing a slave: When he freed the slave, his condition became void.

Hazrat Abu Hayyan al-Taymi narrates from his father that Hazrat Shurayh’s slave-girl came to him with her own slave-girl and said, “O Abu Umayyah! I have set this slave-girl of mine free.” He replied, “I have heard what you are saying.” The slave-girl said, “I have set the condition of service as long as I am alive.” Hazrat Shurayh said, “This is upon her; if she wishes, she may do so.”

Hazrat Dhahak said regarding the woman who freed her servant and then made an exception, he said: She is free.

It is narrated from Hazrat Sa’d bin Al-Akhram that a man came to Hazrat Ibn Mas’ud (may Allah be pleased with him) and said: I have freed my slave-girl, and I have set a condition upon her that she will serve me as a slave serves her master, except for sexual relations. Then, when I was strict with her in her servitude, she says that she is free. He (Ibn Mas’ud) said: She does not have the right to say this. Take her and make her fulfill the condition you have set upon her; it is necessary for her to fulfill it.

It is narrated from Safina that Umm Salama (may Allah be pleased with her) set him free and placed this condition upon him that as long as he lived, he should serve the Messenger of Allah (peace and blessings be upon him).
