Two People Share Property Without Mixing Their Shares
Hadith 24581
٢٤٥٨١ - حدثنا أبو بكر قال: حدثنا (عبيد اللَّه) (١) بن موسى قال: (أخبرنا) (٢) سفيان عن جابر (عن الشعبي) (٣) في رجلين اشتركا، فأخرج كل واحد ⦗٥٤٤⦘ (منهما) (٤) عشرة آلاف ولم (يخلطاها) (٥) فعمل أحدهما بما عنده (فتوى) (٦)، فلم (يره) (٧) شريكا (وقال) (٨): النقصان وما (توى) (٩) عليه، وليس على الآخر منه شيء.
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) regarding those persons who are partners, each of whom took out ten thousand dirhams, but did not mix them together. Then one of them conducted business with the wealth in his possession, but all the wealth was lost. He does not consider the other as a partner. He (Sha'bi) replied that the loss and destruction will be upon him alone. The other has no share in it.
Hadith 24582
٢٤٥٨٢ - حدثنا أبو بكر قال: حدثنا عبيد اللَّه (قال) (١): قال سفيان: لا تكون شركة بينهما حتى يخلطا أموالهما.
Hazrat Sufyan says that there will be no partnership between two persons until their wealth is mixed together.
