في القوم يكونون شركاء في الدار
People Partnering in a Single House
Hadith 24262
٢٤٢٦٢ - حدثنا أبو بكر قال: حدثنا حفص عن ليث عن الشعبي في القوم يكونون شركاء في الدار، فاشترى بعضهم من بعض، قال: ليس للآخرين شفعة.
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that there were several people sharing a house; some of them bought the house from others among them, so the other partners do not have the right of pre-emption (shuf'ah).
Hadith 24263
٢٤٢٦٣ - حدثنا أبو بكر قال: حدثنا حفص (عن) (١) (عمرو) (٢) عن الحسن مثله.
It is also narrated in the same way from Hasan.
Hadith 24264
٢٤٢٦٤ - حدثنا أبو بكر قال: حدثنا الضحاك (بن) (١) مخلد عن ابن (جريج) (٢) قال: قلت لعطاء: ابتعت أنا ورجل دارا، ولرجل سدس وللآخر نصف فباع -يعني صاحبي-، آخذه أنا وهم (جميعًا) (٣) (أو) (٤) آخذه دونهم، قال: (لا) (٥)! (بل) (٦) تأخذه دونهم.
Hazrat Ibn Jurayj says that I asked Hazrat Ata (may Allah have mercy on him) that I and another person together bought a house, my companion has a sixth share in it. Half of the house belongs to the other person. My companion has sold his share. Will all of us take a share from that amount or only I will take? He replied that only you will take a share from that amount.
Hadith 24265
٢٤٢٦٥ - حدثنا أبو بكر قال: حدثنا الضحاك بن مخلد عن ابن جريج قال: أخبرني ابن أبي حسين (عن) (١) طاوس (قال) (٢): هم فيه سواء.
Hazrat Tawus says that all the partners are equal in it.
