No Shuf‘ah When Two Houses Share One Road
Hadith 24229
٢٤٢٢٩ - حدثنا أبو بكر قال: حدثنا عبد السلام بن حرب عن (عمرو) (١) عن الحسن قال: إذا كان بين الدارين طريق فلا شفعة (بينهما) (٢).
Hasan (may Allah have mercy on him) said that if there is only one path between two houses, then there is no right of pre-emption (shuf‘a) in them.
Hadith 24230
٢٤٢٣٠ - حدثنا أبو بكر قال: حدثنا عباد بن العوام عن عبيدة قال: سمعت إبراهيم يقول: إذا كان بينهما طريق (فاصل) (١) فلا شفعة (٢).
Ibrahim says that if there is a separate path between the two houses, then there is no right of pre-emption.
Hadith 24231
٢٤٢٣١ - حدثنا أبو بكر قال: حدثنا غندر عن شعبة قال: سألت الحكم وحمادا عن الشفعة فقال (١): إذا كانت الدار إلى جنب الدار ليس بينهما طريق (ففيها) (٢) شفعة.
Hazrat Hakam and Hazrat Hammad were asked about pre-emption (shuf‘a). They said: If there is no path between two houses, then the right of pre-emption exists in them.
