Hadith 24083
٢٤٠٨٣ - حدثنا أبو بكر قال: حدثنا ابن مبارك عن ابن جريج قال: أخبرني ابن أبي مليكة أن امرأة كوتبت، فولدت ولدين في مكاتبتها، ثم ماتت، فسئل عن ذلك ⦗٤١٤⦘ عبد اللَّه بن الزبير فقال: إن (أقاما) (١) بكتابة (أمهما) (٢) فذلك (لهما) (٣)، فإذا أديا عتقا (٤).
It is narrated from Ibn Abi Mulaykah that a woman (slave) was given a contract of manumission (kitabah). Then, during the period of kitabah, she gave birth to two children. Later, she passed away. Regarding this, Abdullah bin Zubair (may Allah be pleased with him) was asked. He said: If her children wish to remain on their mother’s contract of kitabah, then they are permitted; when they pay (the agreed amount), they will become free.
Hadith 24084
٢٤٠٨٤ - حدثنا أبو بكر قال: حدثنا (هشيم) (١) عن مغيرة عن إبراهيم قال: ولد المكاتبة بمنزلتها، يعتقون بعتقها ويرقون برقها، (فإن) (٢) ماتت (سعوا) (٣) فيما بقي من مكاتبتها، فإن أدوا عتقوا، وإن عجزوا (ردوا) (٤).
Ibrahim says that the children of a mukatab are in his status; they will be freed with his freedom, and will remain slaves with his slavery. And if their mother passes away, then they will try to pay the remaining amount of the contract of manumission; if it is paid, they will be freed, and if it is not paid, they will remain slaves.
Hadith 24085
٢٤٠٨٥ - حدثنا أبو بكر قال: حدثنا حفص عن جعفر عن أبيه عن علي قال: (ولده بمنزلته) (١) في السعي -يعني (المكاتب) (٢) (٣).
Hazrat Ali (may Allah be pleased with him) said that the children of a mukatab (contracted slave) are also considered like him in striving to fulfill the payment of the contract.
