الرجل يقول: إن بعتك (غلامي) فهو حر
If One Says: If I Sell My Slave to You, He Is Free
Hadith 24050
٢٤٠٥٠ - [حدثنا أبو بكر قال]: حدثنا معاذ بن معاذ عن أشعث عن الحسن في رجل قال لرجل: إن بعتك غلامي فهو حر، وقال الآخر: إن اشتريته فهو حر، قال: يعتق من مال (البائع) (١)؛ لأنه حنث قبله.
It is narrated from Hasan that a person said to another: If I sell my slave to you, then he is free. The other said: If I buy him, then he is free. He (the narrator) said: He will be considered free from the seller's side because he was the first to make an oath.
Hadith 24051
٢٤٠٥١ - حدثنا أبو بكر قال: حدثنا إسماعيل بن علية عن هشام (الدستوائي) (١) قال: حدثنا حماد عن إبراهيم قال: (هو) (٢) حر من (مال) (٣) البائع لأنه حنث أولهما.
Ibrahim says that he will be freed on behalf of the seller because he was the first to break the oath between the two.
