Buyer and Seller Have Choice Until They Separate
Hadith 24035
٢٤٠٣٥ - حدثنا أبو بكر قال: حدثنا ابن عيينة عن عبد اللَّه بن دينار عن ابن عمر قال: قال رسول اللَّه ﷺ: "البيعان بالخيار في بيعهما، ما لم (يتفرقا) (١)، إلا أن يكون بيعهما (عن) (٢) خيار" (٣).
The Noble Prophet (peace and blessings be upon him) said: The two parties involved in a sale have the option (to cancel the transaction) until they separate, unless there is a condition of option (khiyar) in their sale (then even after separation, they will have the option).
Hadith 24036
٢٤٠٣٦ - حدثنا أبو بكر قال: حدثنا يزيد بن هارون عن (سعيد) (١) عن قتادة عن صالح (٢) أبي (الخليل) (٣) عن عبد اللَّه بن الحارث عن حكيم بن حزام أن النبي ﷺ قال: "البيعان بالخيار ما لم (يتفرقا) (٤) " (٥).
The Noble Prophet (peace and blessings be upon him) said: The seller and the buyer have the option (to cancel the transaction) until they separate.
Hadith 24037
٢٤٠٣٧ - حدثنا أبو بكر قال: حدثنا الفضل بن دكين قال: حدثنا حماد بن زيد عن جميل بن مرة عن أبي (الوضيء) (١) عن أبي برزة قال: قال رسول اللَّه ﷺ: "البيعان بالخيار ما لم (يتفرقا) (٢) " (٣).
It is narrated from the Prophet Muhammad (peace and blessings be upon him) in the same manner.
Hadith 24038
٢٤٠٣٨ - [حدثنا أبو بكر قال: حدثنا هاشم بن القاسم قال: حدثنا (أيوب) (١) ابن عتبة قال: حدثنا أبو كثير (السحيمي) (٢) عن أبي هريرة قال: قال رسول اللَّه ﷺ: "البيعان بالخيار ما لم (يتفرقا) (٣) من بيعهما، أو يكون (بينهما) (٤) (خيار) (٥) " (٦).
The Noble Prophet (peace and blessings be upon him) said: The two parties involved in a sale have the option (to cancel or confirm the sale) until they separate, or unless there is a conditional option or something similar between them.
Hadith 24039
٢٤٠٣٩ - حدثنا أبو بكر قال: حدثنا جرير بن عبد الحميد عن عبد العزيز بن رفيع عن ابن أبي مليكة وعطاء (قالا) (١): قال رسول اللَّه ﷺ: "البيعان بالخيار حتى ⦗٤٠٢⦘ (يتفرقا) (٢) عن رضى"] (٣) (٤).
The Noble Prophet (peace and blessings be upon him) said: The two parties involved in a sale have the right of option as long as they do not separate with mutual consent.
Hadith 24040
٢٤٠٤٠ - حدثنا أبو بكر قال: حدثنا أبو الأحوص عن عبد العزيز بن رفيع (عن) (١) ابن أبي مليكة قال: قال رسول اللَّه ﷺ: "البيعان بالخيار ما لم (يتفرقا) (٢) " (٣).
The Noble Prophet (peace and blessings be upon him) said: The sellers have the option (to finalize or cancel the sale) before they separate.
Hadith 24041
٢٤٠٤١ - [حدثنا أبو بكر قال: حدثنا وكيع عن شعبة عن الحكم عن شريح قال: البيعان بالخيار ما لم (يتفرقا) (١)] (٢).
It is narrated in the same way from Hazrat Shurayh.
Hadith 24042
٢٤٠٤٢ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن الشعبي (١) في رجل اشترى من رجل برذونا، فأراد أن يرده قبل أن (يتفرقا) (٢) فقضى الشعبي أنه قد وجب عليه، فشهد عنده أبو الضحى أن شريحا أُتي في مثل ذلك فرده على البائع، فرجع الشعبي إلى قول شريح.
It is narrated from Hazrat Sha'bi that a person bought a horse from another, then before parting he wanted to return it, but Hazrat Sha'bi declared the sale binding upon him. Then Abu al-Duha testified before him that a similar issue had come before Hazrat Shurayh, and he had returned the sold item to the seller. Hazrat Sha'bi then accepted the statement of Hazrat Shurayh.
Hadith 24043
٢٤٠٤٣ - حدثنا أبو بكر قال: حدثنا ابن أبي زائدة عن (محمد) (١) بن إسحاق عن نافع عن ابن عمر، قال: البيعان بالخيار ما لم يتفرقا، فكان ابن عمر إذا باع ⦗٤٠٣⦘ انصرف ليوجب البيع (٢).
Hazrat Ibn Umar (may Allah be pleased with both of them) narrates that the sellers have the option (to finalize or cancel the sale) until they separate. When Hazrat Ibn Umar (may Allah be pleased with both of them) would make a sale, he would move away from there (separate) so that the sale would become final.
Hadith 24044
٢٤٠٤٤ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن (ابن) (١) أبي السفر عن الشعبي عن شريح قال: البيعان بالخيار ما لم يتفرقا.
Hazrat Shurayh says that the sellers have the option (to cancel the sale) until they separate.
Hadith 24045
٢٤٠٤٥ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا هشام (بن) (١) زياد عن سعيد بن المسيب قال: البيعان بالخيار ما لم يتفرقا.
The same is also narrated from Hazrat Saeed bin Al-Musayyib.
Hadith 24046
٢٤٠٤٦ - حدثنا أبو بكر قال: حدثنا أبو الأحوص عن عبد العزيز بن رفيع عن ابن أبي مليكة قال: قال رسول اللَّه ﷺ: "البيعان بالخيار ما لم يتفرقا" (١).
It is also narrated in the same way from the Noble Prophet (peace and blessings of Allah be upon him).
