Hadith 24031
٢٤٠٣١ - حدثنا أبو بكر قال: حدثنا وكيع (عن) (١) الأوزاعي عن واصل بن أبي جميل عن مجاهد قال: اشترك أربعة رهط على عهد رسول اللَّه ﷺ (في) (٢) زرع، فقال أحدهم: قبلي الأرض، وقال الآخر: قبلي الفدان، وقال الآخر: قبلي البذر، وقال الآخر: علي العمل، فلما (استحصد) (٣) الزرع تفاتوا فيه إلى النبي ﷺ (٤) فجعل الزرع لصاحب البذر، وألغى صاحب الأرض، وجعل لصاحب الفدان شيئا معلوما، وجعل لصاحب العمل درهما كل يوم (٥).
It is narrated from Hazrat Mujahid that during the time of the Holy Prophet (peace be upon him), four men entered into a partnership in agriculture. One of them said: "The land is from my side," the second said: "The ox is from my side," the third said: "The seed is from my side," and the fourth said: "All the work is my responsibility." When the crop was ready, they came to the service of the Holy Prophet (peace be upon him) to ask about the ruling. The Prophet (peace be upon him) allotted the crop to the one who provided the seed, the straw to the one who provided the land, a known share to the one who provided the ox, and for the one who did the work, he fixed one dirham per day. Hazrat Mak’hool (may Allah have mercy on him) says that this hadith is more beloved to me than a servant (slave). Hazrat Waki’ says that we prefer trade in gold, silver, and food over agriculture. Hazrat Waki’ says that in our opinion, sharecropping by half, by a third, and by a quarter is also permissible because people (commonly) do this.
