Musannaf Ibn Abi Shaybah

Ibrahim says that if a person gives grain to a boatman, then whatever deficiency occurs in it, he will be responsible for it.

Hazrat Ata says regarding the person who leased land for cultivation with a fixed rent: if there is an increase (in produce), it is for them, and if there is a loss, that too is upon them. And if the tenants are content with this and acknowledge it, then there is no harm.

Hazrat Ibn Sirin (may Allah have mercy on him) said regarding the person who rented out to a boatman on the condition that the loss will be upon him, and whatever increase there is will be his, he said: the increase is for the owner of the food, and the loss is upon the boatman.

Hasan was asked: If a boatman carries grain? He replied: The profit is for him and the loss is upon him.
