Musannaf Ibn Abi Shaybah

Hazrat Shurayh and Hazrat Abdullah state that if a person constructs something on the property of a people without permission, it will be demolished, and if he built it with their permission, then he will be given compensation.

It is narrated in a similar manner from Hazrat Ali (may Allah be pleased with him).

Hazrat Shurayh says that if a person constructs (a building) at the place of a people without their permission, it will be demolished, and if it was built with their permission, he will be given compensation.

Hazrat Zakariya narrates that I asked Hazrat Aamir: A person rented his neighbor’s wall and built upon it, then the neighbor wants to demolish it? He replied: The owner of the wall will pay him whatever expenses he incurred.

Ibrahim narrates that Hazrat Shurayh said to the owner of the wall: Demolish its construction (you may demolish it).

Hazrat Qatadah and Hazrat Abu Hashim state that if a person first gives someone permission to build, and then wants to evict him, he must pay the cost of the construction.

Hazrat Ash'ath narrates that a person rented a wall to another, and he built upon it. Hazrat Shurayh said to the owner of the wall: Give him maintenance.
