Renting Uncultivated Land for Gold
Hadith 23885
٢٣٨٨٥ - حدثنا أبو بكر قال: حدثنا أبو الأحوص عن طارق عن سعيد بن المسيب عن رافع بن خديج عن النبي ﷺ (قال) (١): "إنما يزرع ثلاثة: رجل (منح) (٢) (أرضًا) (٣) فهو (يزرع ما منح) (٤) ورجل (له أرض فهو يزرعها) (٥)، ورجل (استكرى) (٦) أرضا بذهب أو فضة" (٧).
The Noble Prophet, peace and blessings be upon him, said: Indeed, there are only two ways of cultivating land: one is a person to whom land is given, so he cultivates it; the second is a person who owns land and cultivates it; and the third is a person who takes land on rent in exchange for gold and silver.
Hadith 23886
٢٣٨٨٦ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان عن ربيعة (بن) (١) أبي عبد الرحمن (عن حنظلة) (٢) بن قيس قال: سألت رافع بن خديج عن (كراء) (٣) الأرض البيضاء بالذهب والفضة فقال: حلال لا بأس به (٤).
Hazrat Hanzala narrates that I asked Hazrat Rafi’ bin Khadij (may Allah be pleased with him) about giving barren land on rent in exchange for gold and silver. He replied: It is permissible; there is no harm in it.
Hadith 23887
٢٣٨٨٧ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان عن يعلى بن عطاء عن القاسم بن عبد اللَّه قال: سألت (سعدا) (١) عن (كراء) (٢) الأرض (بالذهب) (٣) والفضة فقال: لا بأس به، ذلك قرض الأرض (٤).
Hazrat Sa'd was asked about leasing barren land in exchange for gold and silver? He replied: There is no harm; this is a loan of land.
Hadith 23888
٢٣٨٨٨ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا هشام الدستوائي عن قتادة عن سعيد بن المسيب قال: لا بأس (بكراء) (١) الأرض بالذهب والفضة.
Hazrat Saeed bin Al-Musayyib says that there is no harm in renting barren land in exchange for gold and silver.
Hadith 23889
٢٣٨٨٩ - حدثنا أبو بكر قال: حدثنا يحيى بن زكريا عن داود عن سعيد بن جبير قال: لا بأس (بكراء) (١) الأرض البيضاء بالذهب والفضة.
The same is narrated from Hazrat Saeed bin Jubair (may Allah have mercy on him).
Hadith 23890
٢٣٨٩٠ - حدثنا أبو بكر قال: حدثنا عبد الوهاب الثقفي عن (عبيد اللَّه) (١) بن عمر قال: كان سالم وسعيد بن المسيب وعروة والزهري لا يرون (بكراء) (٢) الأرض البيضاء بالذهب والفضة بأسا.
Hazrat Salim, Hazrat Saeed bin Al-Musayyib, Hazrat Urwah, and Hazrat Zuhri (may Allah have mercy on them) did not consider it objectionable to lease land of Rayy in exchange for gold and silver.
Hadith 23891
٢٣٨٩١ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان عن عبد الكريم عن سعيد ابن جبير عن ابن عباس قال: إن أمثل ما أنتم صانعون: أن تستأجروا الأرض البيضاء بالذهب والفضة (١).
Hazrat Ibn Abbas (may Allah be pleased with them both) narrates that indeed the best occupation among your occupations is that you lease land in exchange for gold and silver.
Hadith 23892
٢٣٨٩٢ - حدثنا أبو بكر قال: حدثنا ابن علية عن أيوب عن (الفضيل) (١) عن سالم قال: أما الأرض البيضاء (فإنا) (٢) نكريها بالذهب والورق.
Hazrat Salim says that indeed we will lease this land of Kura in exchange for gold and silver.
Hadith 23893
٢٣٨٩٣ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن إبراهيم قال: لا بأس أن تستأجر الأرض البيضاء بالذهب والورق، وما أراد إن (تستأجرها) (١) به.
Ibrahim says that if a person intends to lease out land, he can lease uncultivated land in exchange for gold and silver.
Hadith 23894
٢٣٨٩٤ - حدثنا أبو بكر قال: حدثنا يعلى بن عبيد عن حجاج بن دينار قال: سألت أبا جعفر عن الأرض البيضاء ليس فيها شجر ولا زرع؛ تستأجرها (بالدراهم والدنانير) (١) قال: هو حسن، كذلك نفعل بالمدينة.
Hazrat Abu Ja'far, may Allah have mercy on him, was asked whether we can lease barren land, on which there are no trees or crops, in exchange for dirhams and dinars? He replied: This is good, we used to do the same in Madinah Munawwarah.
Hadith 23895
٢٣٨٩٥ - حدثنا أبو بكر قال: حدثنا يزيد بن هارون عن (إبراهيم) (١) بن سعد عن محمد بن عكرمة (٢) (بن) (٣) الحارث عن محمد بن عبد الرحمن [(بن) (٤) أبي لبيبة] (٥) عن سعيد بن المسيب عن (سعد) (٦) قال: كنا نكري الأرض على عهد رسول اللَّه ﷺ بما (٧) على السواقي من الزرع وما صعد بالماء (منها) (٨) فنهانا رسول ⦗٣٦٤⦘ اللَّه ﷺ-عن ذلك وأمرنا أن (نكري) (٩) بالذهب والورق (١٠).
Hazrat Sa'd (may Allah have mercy on him) narrates that during the time of the Messenger of Allah ﷺ, we used to rent out land to those who irrigated it. The Holy Prophet ﷺ forbade us from this and said that we should rent it out in exchange for gold and silver.
Hadith 23896
٢٣٨٩٦ - حدثنا أبو بكر قال: حدثنا أبو خالد الأحمر عن يحيى بن سعيد قال: سألت سعيد بن المسيب عن يتيم لي له أرض فقال: إن كنت مكريها فأكرها بذهب أو فضة.
Yahya narrates that I asked Hazrat Saeed bin Al-Musayyib, "I have an orphan with me who also owns land. What should I do?" He replied, "If you want to lease out the land, then give it for dirhams and dinars in exchange."
Hadith 23897
٢٣٨٩٧ - حدثنا أبو بكر قال: حدثنا أبو الأحوص عن معاوية بن إسحاق قال: سألت سعيد (بن جبير) (١) عن إجارة الأرض فقال: لا بأس بها.
It was asked from Hazrat Saeed bin Jubair (may Allah have mercy on him) about giving land on rent? He replied: There is no harm in it.
