Musannaf Ibn Abi Shaybah

Hazrat Salim narrates from his father that during the time of Hazrat Umar (may Allah be pleased with him), people used to cultivate lands and mark them with stones. He (may Allah be pleased with him) said: Whoever cultivates barren land, it belongs to him.

Hazrat Umar (may Allah be pleased with him) wrote (to the officials): Whoever cultivates barren land is more entitled to that land.

It is narrated from Hazrat Jabir (may Allah be pleased with him) that the Holy Prophet (peace and blessings be upon him) said: Whoever cultivates barren land, he will be rewarded for it, and whatever is eaten from it by passersby, that will be charity for him.

The Noble Prophet (peace and blessings be upon him) said: Whoever cultivates barren land, it becomes his property. And the offspring of the oppressor have no right to it.

It is narrated in a marfu’ form from Hazrat Abu Bakr bin Hafs (may Allah have mercy on him) that whoever cultivates barren land at the request of the townspeople, the land will belong to him. And moreover, he will also receive a reward for it.

Hazrat Tawus says that whoever cultivates barren land, its area belongs to him.

It is narrated in a similar manner from Hazrat Ibn Abbas (may Allah be pleased with them both).

It is narrated from Hazrat Tawoos that the Holy Prophet (peace be upon him) said: Whoever cultivates barren land, its area belongs to him.

Hasan says that whoever cultivates barren land that previously belonged to no one, it will belong to him. Hisham says that Umar bin Abdul Aziz, may Allah have mercy on him, also wrote the same.

It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that the Holy Prophet (peace and blessings be upon him) said: Whoever leaves his mount in a place of destruction, it will belong to the one who takes it and cares for it.

Hasan was asked that a person left his animal in barren land, from where another person took it and raised it, and took care of it until it became healthy and well? He replied: It will belong to the one who gave it life and raised it.

It is narrated from Hazrat Samurah that the Holy Prophet (peace and blessings be upon him) said: Whoever encloses barren land with a boundary wall, it will belong to him.
