No Return If a Gift Is Destroyed
Hadith 23739
٢٣٧٣٩ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان عن أبي (بكر) (١) عن سعيد بن جبير.
Hazrat Sha'bi (may Allah have mercy on him) said that when a gift is destroyed, then there is no taking it back.
Hadith 23741
٢٣٧٤١ - حدثنا أبو بكر قال: حدثنا ابن أبي زائدة عن حجاج عن الحكم عن إبراهيم عن عمر قال: هو أحق بها ما لم (يُثَبْ) (١) (منها) (٢) أو يستهلكها أو (يموت) (٣) أحدهما (٤).
Hazrat Umar (may Allah be pleased with him) says that he is more entitled to the gift until he receives compensation, or the gifted item is destroyed, or one of the two becomes incapable.
Hadith 23742
٢٣٧٤٢ - حدثنا أبو بكر قال: حدثنا وكيع (عن) (١) أبي ليلى عن (أبي حريز) (٢) قال: كتب عمر بن عبد العزيز: إذا استهلكت الهبة أو (أثيب) (٣) منها أو وهبت لذي رحم فليس له أن يرجع.
Hazrat Umar bin Abdul Aziz wrote: When a gift is destroyed and compensation has been received, or if the gift is given to a close blood relative (with whom marriage is prohibited), then there is no right to take it back.
