الرجل يمر برقيق على العاشر
A Person Passes with His Slave by the Collector of ‘Ushr
Hadith 23724
٢٣٧٢٤ - حدثنا أبو بكر قال: حدثنا (وكيع قال: حدثنا) (١) شعبة قال: سألت الحكم وحمادا عن رجل مر برقيق على عاشر، فقال: هؤلاء أحرار، [(قال) (٢) الحكم] (٣): ليس بشيء.
Hazrat Sha’bah says that I asked Hazrat Hakam and Hazrat Hammad that a person passed by the tax collector with slaves and said, “All of these are free.” Hazrat Hakam said that saying this means nothing, and Hazrat Hammad said, “I fear that they will become free.”
Hadith 23726
٢٣٧٢٦ - حدثنا أبو بكر قال: حدثنا معاذ بن معاذ عن أشعث عن (الحسن) (١) في رجل مر بمملوك على عاشر فقال: هو حر، (فقال) (٢): كان لا يرى أن يعتق بهذا القول، ولا يرى بأسا أن يقوله.
Hasan says that if a person passes by the collector with a slave and says, "This one is free," he (Hasan) said that by saying this, the slave will not become free, and there is no harm in saying this.
Hadith 23727
٢٣٧٢٧ - حدثنا أبو بكر قال: حدثنا أبو أسامة عن جرير بن حازم عن حماد (عن) (١) إبراهيم في الرجل يمر بالرقيق على (العاشر) (٢) (فيقول) (٣): هم أحرار، ينوي: من العمل، قال: لا (يعتقون) (٤).
Ibrahim (may Allah have mercy on him) said regarding the person who passed by the tax collector with a slave and said, "He is free," intending by this that the servants are free from work and labor. He replied that the slave would not become free.
