Selling Goods for a Fixed Period with a Condition of Preferential Right if Sold Before the Term
Hadith 23650
٢٣٦٥٠ - حدثنا أبو بكر قال: حدثنا (معتمر) (١) بن سليمان عن سلم بن أبي (الذيال) (٢) قال: سألت محمدًا عن رجل باع سلعة إلى (شهرين) (٣) شرط على المشتري إن باعها قبل الشهرين أن ينقده، قال: لا أعلم به بأسا.
Muhammad, may Allah have mercy on him, was asked about a person who sold goods for two months and stipulated to the buyer that if he had to sell it before two months, he should sell it back to him. He replied that he saw no harm in it.
Hadith 23651
٢٣٦٥١ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن عبد العزيز ابن رفيع قال: بعت من رجل جارية وشرطت عليه إن تبعها نفسي، قال: ⦗٢٩٩⦘ (فتبعتها) (١) نفسي فخاصمته إلى شريح فقال: قد أقررت بالبيع فبينتك على الشرط.
Hazrat Abdul Aziz bin Rafee' says that I sold a slave girl to a person, and made it a condition that he would sell her back to me. Then he sold her back to me. I took this dispute to Hazrat Shurayh. He said: You have admitted to the sale, so you will have to bring witnesses for the condition.
Hadith 23652
٢٣٦٥٢ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا شريك (عن) (١) عبد العزيز بن رفيع عن (شريح) (٢) أنه أجاز الشرط لبضعة عشر يوما.
Hazrat Shurayh (may Allah have mercy on him) declared the condition permissible (enforceable) for a few days.
