Buying a Check Document in Exchange for Clothes
Hadith 23595
٢٣٥٩٥ - حدثنا أبو بكر (قال: حدثنا وكيع) (١) قال: حدثنا سفيان عن منصور عن إبراهيم قال: لا بأس أن يشتري الصك (بالبز) (٢) على الرجل نوى أو لم (ينو) (٣).
Ibrahim says that if a person buys clothes in exchange for a cheque, there is no harm in it.
Hadith 23596
٢٣٥٩٦ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا زكريا عن الشعبي، قال: (سألته) (١) عن رجل اشترى من رجل (صكا فيه) (٢) ثلاثة دنانير بثوب، قال: لا يصلح.
Hazrat Sha'bi (may Allah have mercy on him) was asked about a person who bought a document from another in exchange for clothes, in which there are three dinars? He replied, "This is not permissible."
Hadith 23597
٢٣٥٩٧ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن عبد اللَّه بن أبي السفر عن الشعبي أنه كرهه وقال: هو غرر.
Hazrat Sha'bi disliked this and used to say that it is deception.
Hadith 23598
٢٣٥٩٨ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن هشام عن الحسن قال: إذا تبين إفلاس الرجل فلا يجوز عتاقه وعليه دين، وإن لم يتبين إفلاسه فعتاقه جائز.
Hasan says that when a person's insolvency becomes apparent, it is not permissible for him to free a slave while he is in debt, and if his insolvency is not apparent, then it is permissible for him to free a slave.
