Hadith 23586
٢٣٥٨٦ - حدثنا أبو بكر قال: حدثنا عبد الوهاب الثقفي عن أيوب عن محمد أن رجلا كاتب غلاما له واشترط ولاءه وميراثه وداره، فلما أدى مكاتبته عتق (ثم مات) (١) فخاصم أولياؤه (في ميراثه) (٢) فأبطل شريح ذلك، فقال المولى: فما يغني (عني) (٣) شرطي (منذ) (٤) عشرين سنة؛ فقال شريح: شرط اللَّه قبل شرطك منذ خمسين سنة.
It is narrated from Muhammad, may Allah have mercy on him, that a man made his slave a mukatab (contracted for freedom), and stipulated for himself the right of wala’, inheritance, and the house. When the slave paid the price of his freedom, he became free. Then he passed away, and after his death, his heirs disputed over the inheritance. Hazrat Shurayh, may Allah have mercy on him, invalidated this. His master said, “What benefit did I get from the condition I set for a year?” Hazrat Shurayh replied: “Allah’s condition has existed for fifty years before you, and it has more right.”
Hadith 23587
٢٣٥٨٧ - حدثنا أبو بكر قال: حدثنا ابن علية عن خالد (أن عديًا) (١) (كتب) (٢) إلى عمر بن عبد العزيز في رجل كاتب غلاما له وشرط (عليه) (٣) سهما من ميراثه، ⦗٢٧٩⦘ فكتب أنه ليس لأحد شرط (ينقض أو ينتقص) (٤) شيئًا من فرائض اللَّه.
Hazrat Adi wrote to Umar bin Abdul Aziz (may Allah have mercy on him) that a person has made his slave a mukatab, and he has stipulated a share for himself from the inheritance. Hazrat Umar wrote in reply: No person is permitted to stipulate a condition that would diminish any of the obligations set by Allah.
Hadith 23588
٢٣٥٨٨ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: سئل عطاء عن رجل كوتب واشترط عليه أهله أن لنا (سهما) (١) من (ميراثك) (٢)، قال: لا، شرط اللَّه قبل شرطهم.
It was asked from Hazrat Ata: A person made a slave a mukatab (contracted for freedom) and his family put this condition that a share from your inheritance will be ours? He replied: No! Allah's condition is established before his condition.
Hadith 23589
٢٣٥٨٩ - حدثنا أبو بكر قال: حدثنا سويد بن عمرو عن أبي عوانة عن مغيرة عن إبراهيم بنحو من (قول) (١) عطاء.
It is also narrated in the same manner from Hazrat Ata.
