Musannaf Ibn Abi Shaybah

Hazrat Ibn Abi Layla, Hazrat Ibn Shubrumah, and Hazrat Rabi’ah al-Ra’i speak about two persons who have a single dinar, one of whom claims half and the other claims the whole purse. Hazrat Ibn Shubrumah said: The one who claims the whole, half is purely his, and the remaining half will be divided equally between the two of them. Hazrat Ibn Abi Layla said: One will get one third and the other will get two thirds. And Hazrat Rabi’ah said: The whole will be divided equally between the two of them.

23484 - Ibn Abi Layla said: (one third and two thirds) (1).

23485 - [And Rabi‘ah said: It is between them (half and half) (1).

It is narrated from Hazrat Harith that there was shared wealth between two persons. One of them claimed half of the wealth, and the other claimed two-thirds. He said: The one who claimed two-thirds will receive half of the wealth, because the one who claimed half is absolved from the other half, and the one who claimed half will be given one-third, because the one who claimed two-thirds is absolved from one-third, and the remaining one-sixth will be shared between the two.
