Those Who Do Not Consider Shuf‘ah Valid in Animals
Hadith 23478
٢٣٤٧٨ - حدثنا أبو بكر قال: حدثنا غندر عن شعبة قال: سألت الحكم وحمادا: في العبد شفعة؟ (قالا) (١): لا.
I asked Hammad and Hakam whether pre-emption (shuf‘a) can be exercised in the case of a slave. They replied: There is no pre-emption in this.
Hadith 23479
٢٣٤٧٩ - حدثنا أبو بكر قال: حدثنا أبو بكر بن عياش عن عبد العزيز بن رفيع عن ابن أبي مليكة قال: قضى النبي ﷺ بالشفعة في كل شيء (١).
It is narrated from Hazrat Ibn Abi Mulaika that the Holy Prophet (peace and blessings be upon him) gave the verdict (command) of pre-emption in everything.
Hadith 23480
٢٣٤٨٠ - [حدثنا أبو بكر قال: حدثنا معاذ عن أشعث عن الحسن قال: كان يقول: (١) ليس في الحيوان شفعة] (٢).
Hasan used to say that there is no pre-emption (shuf‘a) in animals.
Hadith 23481
٢٣٤٨١ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن محمد بن عمارة عن أبي بكر (١) بن (عمرو) (٢) بن حزم عن أبان بن عثمان (قال: قال عثمان) (٣): لا شفعة ⦗٢٤٩⦘ في بئر ولا فحل، و (الأرف) (٤) (يقطع) (٥) كل شفعة (٦).
Hazrat Usman says that there is no right of pre-emption in a well and a male date-palm tree, and the boundary between two lands terminates all mutual rights of pre-emption.
Hadith 23482
٢٣٤٨٢ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا أبان بن عبد اللَّه البجلي قال: سألت عطاء في الثوب شفعة؟ قال: نعم.
It was asked from Hazrat Ata whether there is pre-emption (shuf‘a) in cloth? He replied: Yes.
