Hadith 23325
٢٣٣٢٥ - حدثنا أبو بكر قال: حدثنا سهل (بن) (١) يوسف عن عمرو أن رجلا ⦗٢٠٦⦘ قال لغلامه: الزم فلانًا فإن (فارقته) (٢) فأنت حر، فقال: اشهدوا أني قد فارقته، فرفع ذلك إلى عمر بن عبد العزيز وهو أمير مكة فأجاز عتقه.
It is narrated from Hazrat Amr (may Allah have mercy on him) that a man said to his slave, "Stay with so-and-so, and if you separate from him, you are free." The slave said, "Bear witness that I had separated from him." The matter was brought before Hazrat Umar bin Abdul Aziz (may Allah have mercy on him), who was the governor of Makkah at that time. He decided in favor of the slave's freedom. He said: Hasan (may Allah have mercy on him) also held the same opinion.
Hadith 23327
٢٣٣٢٧ - حدثنا أبو بكر قال: حدثنا أبو خالد الأحمر عن يحيى بن سعيد قال: بلغني أن عمر بن عبد العزيز قال: لا يعتق.
Hazrat Yahya bin Saeed (may Allah have mercy on him) says that it has reached me that Hazrat Umar bin Abdul Aziz used to say: That slave will not be set free.
