Hadith 23245
٢٣٢٤٥ - حدثنا أبو بكر قال: حدثنا عبد السلام عن يزيد بن عبد الرحمن (الدالاني) (١) عن إبراهيم (الصائغ) (٢) عن نافع عن ابن عمر في عبد بين اثنين فأعتق أحدهما نصيبه، قال: عليه أن يعتق بقيته، فإن لم يكن عنده سعى العبد في بقية (ثمنه) (٣)، وكانوا شركاء في الولاء (٤).
It is narrated from Hazrat Ibn Umar (may Allah be pleased with them both) that if a slave is jointly owned by two persons and one of them sets him free, then it is obligatory upon him to also free the remaining part of the slave (by purchasing it). If he does not possess anything, then the slave should work to free himself in exchange for his own neck. Then both of them will share in the slave’s allegiance (wala’).
Hadith 23246
٢٣٢٤٦ - حدثنا أبو بكر قال: حدثنا حفص عن أشعث عن الحسن قال: إن كان موسرًا ضمن، وكان الولاء له، وإن كان معسرًا سعى العبد، وكان الولاء بينهما.
Hazrat Hasan (may Allah be pleased with him) says that if the emancipating owner is wealthy, he will be responsible for the price on behalf of his companion, and the wala’ (right of inheritance) of the slave will go to him. And if he is poor, then the slave himself will strive (to pay the remaining price), and the wala’ will go to both of them.
Hadith 23247
٢٣٢٤٧ - حدثنا أبو بكر قال: حدثنا ابن أبي زائدة عن زكريا عن عامر قال: يسعى العبد والولاء يكون للذي أعتق.
Hazrat Aamir (may Allah have mercy on him) says that the slave will strive himself for the price for another owner, and the right of wala’ will go to the one who set him free.
Hadith 23248
٢٣٢٤٨ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان عن حماد في عبد كان بين رجلين فأعتقه أحدهما قال: الولاء بينهما -يعني- إذا استسعي العبد.
It is narrated from Hazrat Hammad that if a slave is jointly owned by two masters and one of them sets him free, then the slave will strive to pay the price to the other, and the right of inheritance (wala) will belong to both.
Hadith 23249
٢٣٢٤٩ - حدثنا أبو بكر قال: حدثنا محمد بن بشر عن علي بن صالح عن مغيرة عن إبراهيم قال: الولاء للذي أعتق، (سعى) (١) العبد أو لم يسع (٢).
Ibrahim (may Allah have mercy on him) said: Whether the slave strives for his price or not, the right of wala’ will belong to the one who set him free.
