Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Ibn Sirin that a piece of cloth was jointly owned by two men; one of them bought his half for twenty dirhams and the other bought his half for ten dirhams. He said that if both of them sell it by bargaining or by declaring the profit, then the profit will be divided equally between them.

It is narrated from Hazrat Sha'bi (may Allah have mercy on him) and Hazrat Hakam (may Allah have mercy on him) that two men jointly purchased an item; one bought half for twenty dirhams and the other bought half for ten dirhams. Hazrat Sha'bi (may Allah have mercy on him) says that if they sell this item on a murabaha basis, the profit will be according to the ratio of the capital, and if they sell the item on a musawamah basis, the profit will be divided equally. And Hazrat Hakam (may Allah have mercy on him) says that in both cases, the profit will be divided equally.

Hazrat Hasan (may Allah be pleased with him) says that if it is sold on the basis of murabaha, then the profit will be equal to the amount of the principal. And if it is sold on the basis of musawamah, then the profit will be divided equally. Hazrat Qatadah (may Allah be pleased with him) also says the same.

Hazrat Hammad was asked about a commodity shared between two people. One of them incurred a higher cost than the other. He, may Allah have mercy on him, replied: The profit will be distributed in proportion to the capital.
