Musannaf Ibn Abi Shaybah

Ibrahim (may Allah have mercy on him) said that the lessee, the lender (of something for temporary use), and the trustee (one who is entrusted with something) will not be held liable as long as they do not violate the agreed conditions.

Hazrat Sha'bi (may Allah have mercy on him) says that if the trustee, the borrower, and the craftsman (who makes goods for trade) act against the agreed conditions, they will be held liable.

Ibrahim (may Allah have mercy on him) said: If you forbid the agent from buying such and such things and he still buys them, then he will be liable. Hammad (may Allah have mercy on him) said: Whatever profit is made, both of them should give it in charity.

Hazrat Tawus says that the mudarib is a trustee, even if he opposes you.

Hazrat Anas (may Allah be pleased with him) entered into a partnership (Mudarabah) with Hazrat Umar (may Allah be pleased with him), and Hazrat Umar (may Allah be pleased with him) made Hazrat Anas (may Allah be pleased with him) a guarantor for four thousand.

Hasan (may Allah have mercy on him) says that if the mudarib acts against (the agreed conditions with you), he is (still) a trustee.

Hazrat Anas (may Allah be pleased with him) narrates that six thousand (units) of trust were deposited with me, which were lost. Hazrat Umar (may Allah be pleased with him) asked me: Did you suffer any other loss along with it? I replied, no. So he held me liable for it.

Hazrat Abu Hurairah (may Allah be pleased with him) narrates that if the owner of the wealth places a condition on the mudarib that you will not descend into the valley, then if he does descend (and his wealth is destroyed), he will be held liable.

Hazrat Ali (may Allah be pleased with him) said: Whoever distributes the profits, there is no liability upon him.

Hazrat Hasan (may Allah be pleased with him) says that if the mudarib gives the wealth (to someone other than the intended person), then he will be held liable because he is a trustee.

Hazrat Shurayh (may Allah have mercy on him) says that if there is a violation of (the agreed conditions) in a trust or rental, then he will be held liable.

Hazrat Sha’bi (may Allah have mercy on him) says that if the owner of the wealth tells the mudarib not to go beyond such-and-such place, and if he still goes, then he will be held liable.

It is narrated in a similar manner from Hazrat Sha'bi, may Allah have mercy on him.

Hazrat Ibn Sirin (may Allah have mercy on him) said: Do not impose any condition on the mudarib, because I fear that if he opposes it, its harm will fall upon him and upon you.

A person asked Hazrat Zuhri (may Allah have mercy on him) that he was given money for Mudarabah, and he was told not to go outside the city, but he still went. He (Hazrat Zuhri) said, there is no liability upon him.

Hazrat Abu Qalabah says that if certain conditions are imposed on the mudarib that he should not exceed them, and if he still does so, then he will be held liable.

Hazrat Iyas (may Allah have mercy on him) says that he will be the guarantor.

Hazrat Ata (may Allah have mercy on him) says that if someone is forbidden from leaving the city and he still goes out, then he will be held liable.

Hazrat Sha'bi (may Allah have mercy on him) says that if the trustee, the borrower, and the craftsman (the one who makes goods for trade) act against the agreed conditions, they will be held liable.

Hazrat Jabir (may Allah be pleased with him) narrates that Hazrat Abu Bakr (may Allah be pleased with him) did not appoint anyone as a guarantor in the matter of trust.

It is narrated from Hazrat Abdullah bin Ukeem that a person entrusted something to another, and it was destroyed with him, so Hazrat Umar (may Allah be pleased with him) did not hold him liable.

Hazrat Zuhri (may Allah have mercy on him) says: There is no liability upon the one who keeps a trust (amanat) or the one who borrows something (ariyat), except if they are accused (of causing its destruction themselves), then there is liability.
