Musannaf Ibn Abi Shaybah

Hazrat Sha'bi says that if a person, after buying a house, constructs a building on it and then the person entitled to pre-emption comes, he will either take it along with the building or pay its price. Hazrat Hammad says that he can demolish the building and take it.

Hazrat Khalid Hadhdha says that a man bought a house and constructed it, then another man turned out to be entitled to it. In such a case, the value of the land and the building should be assessed. If the entitled person wishes, he may pay the price of the building and take it, and if he refuses, then the land should be handed over to the buyer along with its price.

Hazrat Sufyan says that its structure will be demolished.
