Hadith 21833
٢١٨٣٣ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن الحارث في الرجل يدعي الدابة في يد الرجل فيقول: ضلت مني، قال: لا أقول للشهود: إنه لم (يبع ولم يهب) (١)، ولكن إذا شهدت الشهود أنها دابته، ضلت منه، أحلّفه باللَّه: ما باع ولا وهب.
Hazrat Harith says that if a person claims about an animal in someone’s possession that “this is my animal which was lost from me,” then I would not ask the witnesses to testify that he neither sold it nor gifted it. Rather, when the witnesses testify that this is his animal which was lost, I will have the claimant swear an oath that he neither sold it nor gifted it.
Hadith 21834
٢١٨٣٤ - حدثنا أبو بكر قال: حدثنا جرير عن أشعث عن ابن سيرين عن شريح قال: إذا شهدت الشهود أنها دابته، أحلفه باللَّه: ما أهلكت ولا أمرت (مهلكا) (١).
Hazrat Shurayh says that when the witnesses testify that it belongs to him, then I will make him take an oath that he swears that neither did I destroy it nor did I order anyone to destroy it.
Hadith 21835
٢١٨٣٥ - حدثنا أبو بكر قال: حدثنا حميد بن عبد الرحمن عن حسن بن صالح عن الأسود بن قيس عن حسان بن ثمامة أن حذيفة عرف (جملًا له) (١) فخاصم فيه إلى قاض من قضاة المسلمين، فصارت على حذيفة يمين في القضاء، فحلف باللَّه الذي لا إله إلا هو: ما باع ولا وهب (٢).
Hazrat Hassan bin Thumama narrates that Hazrat Hudhaifa (may Allah be pleased with him) recognized his camel and filed a case with the judge of the Muslims. In the verdict, Hazrat Hudhaifa (may Allah be pleased with him) was required to take an oath, so he swore by Allah, besides whom there is no deity, that he had neither sold it nor gifted it.
