Those Who Say If a Mukatab Pays Part of the Price, He Cannot Return to Slavery
Hadith 21809
٢١٨٠٩ - حدثنا أبو بكر قال: حدثنا علي بن مسهر عن الشيباني (عن الشعبي) (١) قال: قال عبد اللَّه: إذا أدى المكاتب من رقبته فلا رد عليه في الرق (٢).
Hazrat Abdullah says that when a mukatab has paid a portion of the price of his contract of manumission, he cannot return to slavery.
Hadith 21810
٢١٨١٠ - حدثنا أبو بكر قال: حدثنا حفص بن غياث عن الأعمش عن إبراهيم (١).
Hazrat Abdullah (may Allah be pleased with him) says that when a mukatab has paid one third of his contract amount, then he is considered indebted.
Hadith 21812
٢١٨١٢ - [حدثنا أبو بكر قال: حدثنا عبدة بن سليمان عن (هشام) (١) بن عروة عن أبيه قال: إذا أدى المكاتب شطر مكاتبته فهو غريم يتبع] (٢).
Hazrat Urwah says that when a mukatab has paid half of the amount of the kitabah, then he is a debtor.
Hadith 21813
٢١٨١٣ - حدثنا أبو بكر قال: حدثنا عبد الوهاب الثقفي عن يحيى بن سعيد عن عروة أن مروان كان يقضي إذا أدى المكاتب نصف مكاتبته فهو دين يتبع به فذكرت ذلك لعبد الملك بن مروان فأبى أن يأخذ به.
Hazrat Urwah states that Marwan used to give this ruling that when a mukatab pays half of his contract price, the remainder is considered a debt. I mentioned this matter to Abdul Malik bin Marwan, but he refused to accept it.
Hadith 21814
٢١٨١٤ - حدثنا أبو بكر قال: حدثنا ابن أبي زائدة ووكيع عن المسعودي عن القاسم عن جابر بن سمرة قال: قال عمر: إنكم تكاتبون مكاتبين فإذا أدى النصف فلا رد عليه في الرق (١).
Hazrat Umar (may Allah be pleased with him) says that you make slave scribes (mukatab) into scribes, and when they have paid half of the price of their contract, they cannot return to slavery.
Hadith 21815
٢١٨١٥ - حدثنا أبو بكر قال: حدثنا وكيع عن المسعودي عن الحكم عن علي قال: تجري فيه العتاقة في أول نجم (١).
Hazrat Ali (may Allah be pleased with him) said that freedom will be granted from the payment of the first installment.
Hadith 21816
٢١٨١٦ - حدثنا أبو بكر قال: حدثنا عبد الأعلى عن هشام عن الحسن أنه قال: في مكاتب عجز وقد أدى بعض مكاتبته وقد شرطوا عليه فهو رد، قال: إذا أدى النصف فهو غريم.
Hasan says that if a mukatab becomes unable to pay after giving some of the agreed amount, and his owners impose any condition on him, it will be invalid. When he has paid half of the agreed amount, he will be considered indebted.
Hadith 21817
٢١٨١٧ - [حدثنا أبو بكر قال: حدثنا عبد الأعلى عن هشام عن (محمد بن زياد قال) (١): إذا أدى النصف فهو غريم] (٢).
Hazrat Muhammad bin Ziyad says that when he has paid half of the amount of the contract of emancipation, then he will be considered indebted.
Hadith 21818
٢١٨١٨ - حدثنا أبو بكر قال: حدثنا غندر عن شعبة عن منصور عن إبراهيم قال: إذا أدى الثلث أو الربع أو النصف فليس لهم أن يسترقوه.
Ibrahim says that when he has paid one third or one fourth or half, then they can no longer make him a slave.
Hadith 21819
٢١٨١٩ - حدثنا أبو بكر قال: حدثنا ابن عيينة عن الزهري عن (نبهان) (١) عن أم سلمة قالت: قال: رسول اللَّه ﷺ: "إذا كان لاحداكن مكاتب وكان عنده ما يؤدي فلتحتجب منه" (٢).
It is narrated from Hazrat Umm Salamah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: When any of you has a contracted slave (mukatab) and he possesses wealth sufficient to pay the amount of his contract, then conceal this from him.
Hadith 21820
٢١٨٢٠ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن منصور عن إبراهيم قال: كان يقال: إذا أدى الثلث أو الربع فهو غريم.
Ibrahim says that when a third or a quarter has been paid, then he is indebted.
Hadith 21821
٢١٨٢١ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن طارق عن الشعبي عن علي قال: يعتق من المكاتب بقدر ما أدى (١).
Hazrat Ali (may Allah be pleased with him) says that as much of the contract price for emancipation as he pays, to that extent he becomes free.
