Musannaf Ibn Abi Shaybah

Sulaiman Taimi says that I asked Hasan about the verse of the Holy Qur'an { وَأَشْہِدُوا إذَا تَبَایَعْتُمْ }, so he replied: "Do you not see this verse: { فَإِنْ أَمِنَ بَعْضُکُمْ بَعْضًا }?" It seems that Hasan considered the verse regarding the obligation of taking witnesses to be abrogated.

Ismail says that I asked Hazrat Sha’bi whether it is obligatory and necessary to appoint a witness when a person buys something. He replied: No, do you not see this verse of the Holy Qur’an: { فَإِنْ أَمِنَ بَعْضُکُمْ بَعْضًا } If you trust one another, then there is no harm.

Hazrat Abu Saeed Khudri (may Allah be pleased with him) says that the verse { وَأَشْہِدُوا إذَا تَبَایَعْتُمْ } of the Holy Qur'an has been abrogated by { فَإِنْ أَمِنَ بَعْضُکُمْ بَعْضًا }.

Hazrat Rabi bin Anas says that I saw Hazrat Safwan bin Muhammad go to the market one day. He had one dirham with him, and he said, "Who will sell me good grapes in exchange for this one counterfeit dirham?" He bought the grapes and did not appoint anyone as a witness.

Hazrat Hakam states that the verse of the Holy Qur'an { فَإِنْ أَمِنَ بَعْضُکُمْ بَعْضًا } has abrogated the requirement of appointing witnesses.

Hazrat Sha'bi says that there are three types of sales: one is the sale with witnesses and documentation, one is the sale with a pledged collateral in possession, and one is the sale with trust. Then he recited the verse of debt.

Hazrat Abu Musa narrates that the supplication of three types of people will not be accepted: first, the one who gives his wealth to a foolish person—Allah Almighty says, do not give your wealth to the foolish; second, the man who has an ill-mannered wife but neither divorces her nor separates from her; and third, the man who, when he buys something, does not take witnesses.

Hazrat Mujahid says that there are three people whose supplication is not accepted: first, the one who prays against his wife; second, the one who prays against his servant; and third, the person who does not take witnesses while buying and selling.

Hazrat Ibn Sirin says that a person should appoint witnesses while buying and selling.

Hazrat Dhahhak says that while buying and selling, a person should appoint witnesses.
