Musannaf Ibn Abi Shaybah

Hazrat Abu Abdur Rahman says that once we camped beside the wall of a garden, so Hazrat Sa’d said to me that if you wish to become a true Muslim, then do not take anything from it. Then he gave me a dirham and said to buy fruit and food with part of it and fodder with the other part.

Hazrat Ibn Abbas (may Allah be pleased with them) says that if you pass by dates or similar things that have a fence around them, do not enter them without the owner's permission, and when you pass by an open garden, eat from it but do not take anything with you.

Hazrat Yazid bin Asim says that I and the son of Hazrat Talha bin Ubaidullah (may Allah be pleased with him) met Hazrat Aisha (may Allah be pleased with her) when she was returning from Makkah. The son of Hazrat Talha (may Allah be pleased with him) is the nephew of Hazrat Aisha (may Allah be pleased with her). We camped by the wall of a garden and ate the fruit of that garden. When Hazrat Aisha (may Allah be pleased with her) came to know of this, she scolded her nephew and then gave me a thorough admonition as well.

Hazrat Aamir says that you can eat fruit only after paying its price.

Hazrat Saeed bin Jubair says that eat the fruit with the owner's permission.

Hazrat Ibn Abbas (may Allah be pleased with them) says that if there is no fence around the fruits, they should not be considered forbidden, and if there is a fence, they can only be eaten with the owner's permission.

Hazrat Abdur Rahman bin Hazim narrates that I asked Hazrat Mujahid about the fruits that have fallen, so he said: Leave them for the beasts and the birds.

Hazrat Ibn Umar (may Allah be pleased with both of them) declared eating fallen fruits as disliked.
