Hadith 21481
٢١٤٨١ - حدثنا هشيم عن إسماعيل بن سالم قال: سمعت الشعبي يقول: ليس الخلاص بشيء، من باع (مبيعا) (١) (فاستحق) (٢) (فهو) (٣) لصاحبه، وعلى البائع الثمن الذي أخذه به، [ليس عليه أكثر من ذلك.
Hazrat Sha'bi says that there is no such thing as khulas. If someone sold something and later a partner emerged in it, then only the amount received by the seller will be taken from him; no demand for any excess will be made.
Hadith 21482
٢١٤٨٢ - حدثنا أسباط بن محمد عن مطرف عن عامر (عن) (١) (شريح) (٢) قال: لا (يشترط) (٣)] (٤) الخلاص إلا أحمق، (سلم) (٥) كما (بعت أو اردد كما) (٦) أخذت.
Hazrat Shurayh says that only a foolish person would set a condition for khul'. Either return the sold item in the same condition as it was, or keep it.
Hadith 21483
٢١٤٨٣ - حدثنا الضحاك بن مخلد عن ابن جريج عن عطاء أنه كان لا يرى الخلاص شيئا.
According to Hazrat Ata, khul‘ does not have any legal (shar‘i) status either.
Hadith 21484
٢١٤٨٤ - حدثنا إسماعيل بن إبراهيم عن عثمان البتي عن الحسن أن عليًا كان (يحبس) (١) في (الخلاص) (٢) (٣).
Hazrat Usman Bati narrates that Hazrat Ali (may Allah be pleased with him) used to do good for the sake of Khulas.
Hadith 21485
٢١٤٨٥ - حدثنا يحيى بن يعلى التيمي عن منصور عن الحكم عن علي أن رجلًا (ترك) (١) امرأته و (ابنا) (٢) له و (جارية) (٣) فباعت امرأته وابنه الجارية (فوطئها) (٤) الذي ابتاعها فولدت، ثم (جاء صاحب) (٥) الجارية فتعلق بها، (فخاصمه) (٦) إلى علي فقال علي: باعت امرأتك وابنك وقد ولدت من الرجل، سلم البيع، فقال الرجل: أنشدك (اللَّه) (٧) لما قضيت بكتاب اللَّه، فقال: خذ جاريتك وولدها، وقال (للآخر) (٨): خذ المرأة والابن بالخلاص، فلما (أخذ) (٩) سلم الآخر البيع (١٠).
Hazrat Hakam narrates that a man left a slave woman for his wife and his son. His wife and son sold her that slave woman. The buyer had had intercourse with the slave woman and she bore children. After that, the owner of the slave woman came and wanted to reclaim the slave woman the slave woman. This case was presented before Hazrat Ali (may Allah be pleased with him). Hazrat Ali (may Allah be pleased with him) said to him, "Your wife and your son have sold her your slave woman, and the buyer has also had a child with her. You should let the sale stand." He said, "I adjure you by Allah, you have not judged according to the Book of Allah." Hazrat Ali (may Allah be pleased with him) said to that man, "Take your slave woman and her child." Then he said to the other man, "Take khulas from the woman and her son." When compensation was taken from them, the other man handed over the sale.
* From Hadith number 20647, the meaning of khulas (khulas) is understood to be that if a person sells something and the buyer starts using it, then if a rightful owner appears for that thing, the original price of the thing will also be taken from the seller and, to settle the dispute, additional damages will also be collected.
Hadith 21486
٢١٤٨٦ - حدثنا إسماعيل بن علية (عن سلمة) (١) بن علقمة عن ابن سيرين قال: كانت القضاة تقضي فيمن باع شيئا ليس له، فهو لصاحبه إذا طلبه (٢) هو (و) (٣) يؤخذ هذا (بالشروى) (٤).
Hazrat Ibn Sirin states that the judges used to decide that when a person sells something, release is not obligatory upon him; it will be for its owner when he demands it, and it will be taken as its equivalent.
Hadith 21487
٢١٤٨٧ - حدثنا إسماعيل بن علية عن أيوب أن امرأة باعت دارًا لزوجها وهو غائب، فلما قدم (أبى) (١) أن يجيز البيع (فخاصمه) (٢) فيها إلى إياس بن معاوية فجعل المشتري يقول: أصلحك اللَّه! أنفقت (فيها ألفي) (٣) درهم، فقال: (٤) (ألفاك) (٥) عَليّ (ألفاك علي) (٦)، (قال) (٧): (فقضى) (٨) للرجل بداره، وأمر (بامرأته) (٩) إلى السجن، فلما رأى ذلك جوّز البيع.
Ayyub narrates that a woman sold her husband's house in his absence. When he returned, he refused to uphold the sale. The case was brought before the court of Hazrat Iyas bin Mu'awiyah. The buyer began to say, "May Allah set you right, I have spent two thousand dirhams on it." He (Iyas) said, "Your two thousand are due upon me, your two thousand are due upon me." Hazrat Iyas decided the house in favor of the man and ordered the woman to be imprisoned. When they saw this, they approved the sale.
Hadith 21488
٢١٤٨٨ - حدثنا معاذ بن معاذ عن ابن عون عن محمد أنه كان يرى الخلاص شرطا (قويا) (١). وكان يشدد فيه.
Muhammad Khulas considered it a strong condition and was strict about it.
Hadith 21489
٢١٤٨٩ - حدثنا الضحاك بن مخلد عن أشعث عن الحسن أنه كان لا يرى الخلاص شيئا.
According to Hasan, Khul‘ had no legal status.
