Musannaf Ibn Abi Shaybah

Ibrahim and Hazrat Sha’bi state that two partners in any thing will receive profit according to the proportion they have agreed upon, and any loss will be made up from the principal amount.

Hazrat Abu Ja'far says that if a person buys something and then makes someone else a partner in it, then the profit will be according to the agreed proportion, and the loss will be covered from the capital.

Hazrat Jabir bin Zaid and Ibrahim say that if there are two partners, one of whom has invested one hundred and the other two hundred, then the profit will be according to the agreed condition, and the loss will be taken from the principal amount.

Hasan and Hazrat Ibn Sirin say that the profit will be according to the agreed condition, and the loss will be deducted from the principal amount.

Ibrahim says that the profit will be according to the agreed amount, and the loss will be deducted from the principal amount.

It is narrated similarly through another chain.

Hasan says that the profit will be according to the agreed-upon amount, and the loss will be deducted from the principal amount.

Hazrat Shu’bah says that I asked Hazrat Hakam, Hazrat Hammad, and Hazrat Qatadah: If two men work together in partnership, one brings two thousand and the other brings one thousand. They stipulate that the loss will be shared between them and the profit will also be divided equally. What is the ruling on this? They replied that the profit will be according to the agreed condition and the loss will be made up from the principal amount.

Hazrat Shurayh says that if a person makes a transaction on credit, and then includes another person in it, the liability will be on the one who made the transaction. If there is no cash from the second person, then nothing will be obligatory on him, and if there is cash, then the loss will be borne by the one who provided the cash, and the profit will be distributed according to the agreed share.

Hazrat Ali (may Allah be pleased with him) said regarding those who engage in mudarabah and partnership that the profit will be according to the agreed share and the loss will be from the principal amount.

Hazrat Tawus was asked that two men entered into a partnership in such a way that one had more wealth than the other, and he was also made to bear more of the loss. So he replied that there will be no compensation upon him; only the principal amount will be obligatory upon him.
