Musannaf Ibn Abi Shaybah

Hazrat Shurayh (may Allah have mercy on him) says that if a man is presented with his wife, but he claims that he did not have intercourse with her, and the woman also admits this, then the woman will receive half the dowry and 'iddah will also be obligatory upon her. Furthermore, after making this decision, Qazi Shurayh (may Allah have mercy on him) said: I do not confirm your claim upon your own self, nor do I confirm the woman's claim upon her own self.

Hasan (may Allah have mercy on him) says in such a situation that the full dowry will be obligatory upon the man; the woman may take it if she wishes, and if she wishes, she may leave it.
