Does a Woman Receive a Dowry if Separated by Li'an?
Hadith 18287
١٨٢٨٧ - حدثنا أبو بكر قال: نا ابن عيينة عن عمرو عن سعيد بن جبير عن ابن عمر أن النبي ﷺ فرق بين المتلاعنين وقال: "حسابكما على اللَّه، أحدكما كاذب لا سبيل لك عليها"، فقال: يا رسول اللَّه فمالي؟ قال: "لا مال لك، إن كنت صادقًا فهو ⦗٥٣٨⦘ بما استحللت من فرجها، وإن كنت كاذبًا (فذلك) (١) أبعد لك" (٢).
Hazrat Ibn Umar (may Allah be pleased with them both) narrates that the Holy Prophet ﷺ separated the husband and wife who performed li'an and said: "Your reckoning is with Allah; one of you is a liar, and now the man has no right over the woman." Upon this, the man said, "O Messenger of Allah! What is there for me?" The Prophet ﷺ replied, "If you are truthful, then your wealth has been spent in exchange for the permissibility of intimacy with the woman, and if you are lying, then you have no right left whatsoever."
Hadith 18288
١٨٢٨٨ - حدثنا عبد الأعلى عن داود عن سعيد بن جبير أنه فرق بين المتلاعنين قال: (فتعلق) (١) بها (فقال: مالي) (٢) (فقالت) (٣) (له) (٤): لا مال لك قال: فانطلق (إلى) (٥) أبي بردة (فقال) (٦): يذهب مالي وامرأتي جميعًا؟ قال: لا. قال: إن الذي أمرته أن يلاعن بيننا قال: لا شيء لك، قال: وفعل ذلك؟ قال: نعم! قال: (فجئت) (٧) قال: فقال أبو بردة: ما يقول هذا؟ (قال) (٨): قلت: وما (يقول) (٩)؟ قال: يقول: ذهبت امرأته وماله، قال: قلت: ما يحمل الفساق على أن يزنوا؟ يتزوج المرأة ثم يقذفها ثم يلاعنها ولأخذ ماله؟ قال: فكتب به إلى الحجاج قال: فقال: صدق، ثم إن رجلًا أتاني قال: فظننت أن الحجاج أمره فقال: الذي قلت أشيء (قلتَه) (١٠) برأيك أو شيء بلغك؟ (قال) (١١): (قلت) (١٢): قضى به رسول اللَّه ⦗٥٣٩⦘ ﷺ في أخت بني (العجلان) (١٣) (١٤).
Hazrat Dawood narrates that Hazrat Saeed bin Jubair (may Allah have mercy on him) separated a husband and wife who had performed li'an. The man asked, "What will happen to my wealth?" He replied, "You will not get any wealth." Then the man went to Abu Burdah (may Allah have mercy on him) and said, "Have I lost both my wealth and my wife?" He replied, "No." He said, "The person who ordered you to perform li'an has said that you will get nothing." He asked, "Did he really say that?" He replied, "Yes." He said, "I went." Abu Burdah said, "What is he saying?" I said, "What is he saying?" He said, "He says that both his wife and his wealth are gone." I said, "What makes the transgressors commit adultery? He marries a woman, then accuses her, then performs li'an with her, and then takes his wealth back. This matter was written to Hajjaj, and he said, 'He has spoken the truth.'" Then a man came to me, and I thought that Hajjaj had sent him. He said, "Did you say this from your own opinion or did it reach you (from someone)?" I said, "The Messenger of Allah (peace and blessings be upon him) made the same decision regarding the sister of Banu Ajlaan."
