Hadith 18202
١٨٢٠٢ - حدثنا أبو بكر قال: (نا) (١) وكيع عن شعبة عن جابر عن الشعبي قال: ليس على (زان) (٢) عقر.
Hazrat Sha'bi (may Allah have mercy on him) said that there is no 'aqr (compensation for the violated private part) upon the adulterer.
Hadith 18203
١٨٢٠٣ - حدثنا وكيع عن شعبة قال: سألت الحكم وحمادًا عن عبد رجل استكره حرة قالا: لا عقر عليه، لا يضرك حرة كانت أو أمة.
Hazrat Sha’bah (may Allah have mercy on him) says that I asked Hazrat Hakam and Hazrat Hammad (may Allah have mercy on them) about a slave who forcibly commits adultery with a free woman, whether he would be liable for ‘aqr or not? They replied that there is no ‘aqr upon him, whether the woman is free or a slave.
Hadith 18204
١٨٢٠٤ - حدثنا وكيع عن سفيان عن ابن جريج عن عطاء.
Hazrat Ata and Hazrat Zuhri d say that if the woman is a virgin, both 'aqr' and 'hadd' will be obligatory, and if she is previously married, then only 'hadd' will be applied.
Hadith 18205
١٨٢٠٥ - وعن رجل عن الزهري قالا: إن كانت بكرًا فالعقر والحد، وإن كانت ثيبًا فالحد.
18205 - From a man, from al-Zuhri, they said: If she is a virgin, then the dowry and the hadd; and if she is previously married, then the hadd.
Hadith 18206
١٨٢٠٦ - حدثنا وكيع عن أبي حنيفة عن حماد عن إبراهيم (قال) (١): لا يجتمع حد و (٢) صداق على زان.
Ibrahim (may Allah have mercy on him) said that the punishment (hadd) and compensation (diya) cannot be combined for the adulterer.
Hadith 18207
١٨٢٠٧ - حدثنا أبو خالد الأحمر عن أشعث عن الحكم عن إبراهيم قال: إذا (أوقعت) (١) عليه الحد لم (آخذ) (٢) منه العقر.
Ibrahim (may Allah have mercy on him) said that if the prescribed punishment is carried out, then compensation will not be taken.
