Hadith 17386
١٧٣٨٦ - حدثنا أبو بكر عن إسماعيل بن عياش عن ابن (جريج) (١) عن عطاء عن ابن عباس في رجل تزوج امرأة فاشترطوا عليه: إن جئت بمهرها إلى كذا وكذا وإلا فلا نكاح بيننا، قال ابن عباس: لا بأس بذلك (٢).
Hazrat Ibn Abbas (may Allah be pleased with both of them) was asked: If a marriage is made conditional upon the stipulation that if the husband gives the dowry by such-and-such day, then it is valid, otherwise the marriage will not take place. He replied: There is no harm in this.
Hadith 17387
١٧٣٨٧ - حدثنا (١) ابن مبارك عن معمر عن الزهري قال: هو جائز، وكأنه جعله (خلعًا) (٢).
Hazrat Zuhri says that doing so is permissible. This act will be considered under the ruling of khula. Hasan used to say that the marriage is valid and the condition is invalid.
Hadith 17388
١٧٣٨٨ - وكان الحسن يقول: قد جاز النكاح وبطل الشرط.
17388 - Al-Hasan used to say: The marriage is valid and the condition is void.
Hadith 17389
١٧٣٨٩ - حدثنا جرير عن منصور عن إبراهيم قال: كل شرط في النكاح فالنكاح يهدمه إلا الطلاق.
Ibrahim says that in marriage, any condition imposed other than divorce nullifies the marriage.
