Musannaf Ibn Abi Shaybah

Hazrat Hammad says that when a slave woman is freed and her husband has intercourse with her, while she was not aware of her right of option (khiyar), then her right of option will remain. Hasan also used to say the same.

Hazrat Saeed bin Musayyib says that when a slave woman is freed and her husband has intercourse with her, while she was not aware of her right of option (khiyar), then her right of option will remain. If I had the authority, I would have punished the man who did this.

Hazrat Umar (may Allah be pleased with him) said that when a slave woman is set free and her husband has intercourse with her, while she was not aware of her right of option (khiyar), then her right of option will remain. Even if intercourse takes place a hundred times.

Hazrat Ibn Jurayj says that I asked Hazrat Ata that when a slave woman is freed and her husband immediately has intercourse with her, what is the ruling? He replied that he has done very badly. I asked, will she have the right of choice in the case of a free husband? He replied, no.

Hazrat Hakam states that when a slave woman is set free and her husband has intercourse with her, while she was unaware of her right of option (khiyar), then when she comes to know of it, her right of option will remain.

Ibrahim says that when a slave woman is freed and her husband has intercourse with her, while she was not aware of her option (of separation), then when she comes to know, her option will remain.
