Musannaf Ibn Abi Shaybah

Hazrat Ibn Abbas (may Allah be pleased with both of them) says that a freed woman does not have the right of option in the case of her husband being freed.

17338 - And Ikrimah from Ibn Abbas said: They said: She has no choice over the free man (1).

Hazrat Ibn Jurayj says that I asked Hazrat Ata whether a woman who is freed has the right of option (khiyar) if her husband is also freed or not? He replied, "No."

Hazrat Abu Qalabah says that a freed woman does not have the right of option if her husband is freed, but she does have the right of option if her husband is a slave.

Hasan used to say that a woman who is set free does not have the right of option if her husband is also set free.

Hazrat Nafi' narrates that Safiyyah bint Abi Ubaid had a slave. She married him to one of her virgin slave girls. That slave girl did not like her husband and wanted to be freed. Safiyyah bint Abi Ubaid feared that if she freed the slave girl, she would separate from her husband. So, she first freed the male slave and then later freed the slave girl.
