Hadith 17247
١٧٢٤٧ - حدثنا ابن عيينة عن يزيد (بن يزيد) (١) (بن) (٢) جابر عن إسماعيل ابن (عبيد اللَّه) (٣) (عن) (٤) عبد الرحمن بن غنم عن عمر قال: لها شرطها، قال رجل: إذن (يطلقننا) (٥) فقال عمر: إن مقاطع الحقوق عند الشرط (٦).
Hazrat Abdur Rahman bin Ghanm narrates that Hazrat Umar (may Allah be pleased with him) was asked about this matter, so he said that now this condition is the woman's right. A man said, "Then they will leave us." Hazrat Umar (may Allah be pleased with him) said that the matter of rights is at the time of making the condition.
Hadith 17248
١٧٢٤٨ - حدثنا وكيع عن سعيد (بن) (١) عبد العزيز عن إسماعيل بن ⦗٢٩٠⦘ (عبيد اللَّه) (٢) عن ابن غنم (عن عمر) (٣) قال: لها شرطها (٤).
Hazrat Umar (may Allah be pleased with him) said that the fulfillment of the condition is the right of the woman.
Hadith 17249
١٧٢٤٩ - حدثنا وكيع عن عبد الحميد بن جعفر عن يزيد بن أبي حبيب عن أبي الخير عن عقبة بن عامر قال: قال رسول اللَّه ﷺ: "إن أحق (الشروط) (١) أن (يوفى) (٢) به ما استحللتم به الفروج" (٣).
Hazrat Uqbah bin Amir (may Allah be pleased with him) narrates that the Messenger of Allah (peace be upon him) said: Every condition by which the private part is made lawful, its right is that it should be fulfilled.
Hadith 17250
١٧٢٥٠ - حدثنا وكيع عن سفيان عن عبد الكريم عن أبي (عبيدة) (١) أن معاوية سأل (عنها) (٢) عمرو بن العاص فقال: لها شرطها (٣).
Hazrat Abu Ubaidah narrates that Hazrat Muawiyah asked Hazrat Amr bin Aas (may Allah be pleased with him) about this matter, so he replied that fulfilling the condition is the woman's right.
Hadith 17251
١٧٢٥١ - حدثنا ابن عيينة عن عمرو (عن) (١) أبي (الشعثاء) (٢) قال (٣): (إذا) (٤) شرط لها دارها فهو بما (استحل) (٥) من فرجها.
Hazrat Abu Sha’tha says that when a man sets the condition of (staying in) her house for a woman, then this is a condition through which her private part has been made lawful for him.
Hadith 17252
١٧٢٥٢ - حدثنا ابن علية عن أبي حيان قال: (نا) (١) أبو الزناد أن امرأة خاصمت زوجها إلى عمر بن عبد العزيز قد شرط لها دارها حين تزوجها فأراد أن (٢) يخرجها منها فقضى عمر أن لها (دارها) (٣) لا يخرجها منها وقال: والذي نفس عمر بيده لو استحللت فرجها بزنة أحد ذهبًا (لأخذتك) (٤) به لها.
Hazrat Abu Zinad narrates that once a woman brought a case to Hazrat Umar bin Abdul Aziz, stating that her husband had made it a condition at the time of marriage that she would stay in her own house. Now he wants to remove her from that house. Hazrat Umar bin Abdul Aziz said that it is the woman's right to remain in her house; the husband cannot remove her from it. And by the One in whose hand is my life, even if you had made her private parts lawful to you in exchange for gold equal to the mountain of Uhud, I would have taken it from you and given it to her.
Hadith 17253
١٧٢٥٣ - حدثنا وكيع عن شريك عن عاصم عن عيسى بن (حطان) (١) عن مجاهد وسعيد بن جبير قالا: يخرجها.
Hazrat Mujahid and Hazrat Saeed bin Jubair initially gave the verdict that he can expel her from the house. Upon hearing this, Hazrat Yahya bin Juzar said, "Then by what has he made the woman's private part lawful for himself?" Upon this, both of them withdrew their verdict.
