Musannaf Ibn Abi Shaybah

Hazrat Musa bin Abi Aisha (may Allah be pleased with her) says that I asked Marrah whether if a person buys a Magian slave woman or brings her as a captive, can he have intercourse with her before she accepts Islam. He replied that doing so is not permissible. I asked Saeed bin Jubair, and he said that if he does so, then he is no better than that Magian woman.

Hazrat Mak'hool says that it is not permissible to marry a Magian girl before she accepts Islam.

Hazrat Zuhri says that as long as a Magian woman does not profess "La ilaha illallah," a Muslim man cannot approach her. When she professes it, then she is a Muslim.

Hazrat Abu Salamah says that before a Magus woman accepts Islam, a Muslim cannot go near her.

Hasan says that it is not permissible to have intercourse with a Magian woman.

Ibrahim says that when Magian and idolater women are taken captive, they will be invited to accept Islam and urged to do so. If they accept Islam, then it is permissible to have intercourse with them as well as to take service from them. If they do not accept Islam, then intercourse with them is not permissible, but service may be taken from them.

Hazrat Saeed bin Musayyib says that there is no harm in buying a Magian slave-girl and making use of her.

Hazrat Masna says that according to Hazrat Ata, Hazrat Tawus, and Hazrat Amr bin Dinar, it is permissible to have relations with a Magian slave woman, whereas Hazrat Saeed bin Musayyib considers it undesirable.

Hazrat Rabi’ bin Khuthaym says that when you find a polytheist slave woman, do not have intercourse with her until she accepts Islam and performs ghusl (ritual bath).
