Musannaf Ibn Abi Shaybah

Ibrahim says that the same ruling will be applied to both the one who hunts intentionally and the one who does so by mistake.

The same is narrated from Hazrat Ata as well.

Hazrat Saeed bin Jubair says that the penalty was prescribed for one who hunted intentionally, but the same ruling was applied to one who did so by mistake, so that people would be cautious about it.

Ibrahim says that both the one who hunts intentionally and the one who hunts by mistake are equal; the same ruling will be applied to them.

Hazrat Umar wrote (to the officials) that one who hunts intentionally and one who hunts by mistake are both equal.

It is narrated in the same manner from Hazrat Umar.

Ayyub narrates that it was reported that Hazrat Mujahid says: The ruling will not be applied to the one who hunts intentionally; the ruling will be applied to the one who does so by mistake. And it was reported that Hazrat Tawus says: The ruling will not be applied to the one who hunts by mistake; the ruling will be applied to the one who does so intentionally.

Hazrat Salim, Hazrat Qasim, Hazrat Ata, Hazrat Tawus, and Hazrat Mujahid state that if a Muhrim (person in the state of Ihram) kills a lizard or a locust by mistake, no ruling will be applied to him, but if he kills it intentionally, then the ruling will be applied to him.

Hazrat Ibn Abbas (may Allah be pleased with both of them) states that there is nothing (no penalty) upon the one who hunts by mistake.

Hazrat Ata says that both the one who errs unintentionally and the one who does so deliberately are equal.

Hasan also says the same.
